Welcome to SHAKE (“SHAKEapp,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website www.shakeapp.today, mobile application, and related services (collectively, the “Service”).

By creating an account or using SHAKE, you agree to these Terms. If you do not agree, please do not use our Service.

1. Overview

SHAKE is a social networking platform that connects people to share real-life experiences — such as dinners, drinks, sports, cultural activities, and other events (“Events”). Users can join or host events, subscribe to premium features, and purchase participation tickets or credits.

2. Eligibility

• You must be 18 years or older to use SHAKE.
• You confirm that you can legally enter into a binding agreement.
• You will comply with these Terms and all applicable laws.

3. Account Registration

• Provide accurate and current information.
• Maintain the confidentiality of your account credentials.
• Notify us immediately if you suspect unauthorized access to your account.

SHAKE reserves the right to suspend or delete accounts that violate these Terms or appear fraudulent.

4. Payments and Subscriptions

a. Event Payments

SHAKE allows users to join group events (like dinners or meetups) by paying a small participation fee. All payments are processed securely through third-party providers (e.g., Stripe, Apple Pay).

Event payments are refundable only if:

• The event is canceled, or
• The minimum number of participants is not met.

b. Subscriptions

Users may subscribe to premium or membership plans offering additional benefits. Subscriptions automatically renew unless canceled before the next billing cycle. You can manage or cancel subscriptions via your account or app store settings.

c. SHAKE Credits

SHAKE credits can be purchased and used for events or experiences within the app. Credits have no cash value, are non-transferable, and are non-refundable except where required by law.

5. Event Participation

• Arrive on time at the specified meeting point.
• Treat other participants respectfully.
• Follow event-specific rules or host instructions.

SHAKE is not responsible for user behavior, actions, or safety at events. Participants attend events at their own risk.

7. User Conduct

• Do not harass, threaten, or harm others.
• Do not post offensive, misleading, or illegal content.
• Do not misuse SHAKE for spam, fraud, or commercial purposes.
• Do not attempt to hack or disrupt SHAKE systems.

Violations may result in suspension or permanent account termination.

8. Content Ownership

You retain ownership of your posted content but grant SHAKE a non-exclusive, royalty-free, worldwide license to use, display, and distribute it for operating and improving the Service. SHAKE may remove content violating our policies or guidelines.

9. Privacy

Your use of SHAKE is governed by our Privacy Policy, which explains how we collect and use data.

10. Intellectual Property

All intellectual property rights in SHAKE — including trademarks, logos, software, and design — belong to SHAKEapp Inc or its licensors. You may not copy, modify, distribute, or create derivative works without written consent.

11. Disclaimers

• Events may not meet your expectations.
• Other users may not behave appropriately.
• The platform may experience interruptions or errors.

SHAKE is provided “as is” and “as available.” We are not liable for damages, losses, or injuries from your participation or interactions.

12. Limitation of Liability

To the fullest extent permitted by law, SHAKEapp Inc and its affiliates shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the total amount you paid to SHAKE in the past 12 months.

13. Indemnification

You agree to indemnify and hold harmless SHAKEapp Inc and its employees from any claims, losses, or damages arising from your misuse of the Service, violation of Terms, or disputes with users.

14. Termination

SHAKE may suspend or terminate your account if you violate these Terms. You may delete your account anytime through the app. Upon termination, your access and data may be permanently deleted.

15. Changes to These Terms

We may update these Terms periodically. Significant changes will be communicated via email or notification. Continued use of SHAKE after updates means you accept the new Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved in Delaware state or federal courts.
